7. Federal court strikes down Bush’s NSR reforms

A three-judge panel in the U.S. Circuit Court of Appeals for the District of Columbia has ruled unanimously that the Bush Administration’s proposed reform of the New Source Review (NSR) program was “contrary to the plain language” of the Clean Air Act (CAA). The Administration’s rule would have allowed broader categories of “routine maintenance” to take place at coal-fired power plants without triggering required reviews to assess the emissions impacts of these activities and, potentially, the installation of new pollution control systems. The court said that the proposed NSR reform would be allowed under CAA “only in a Humpty Dumpty world.” It added, “we decline to adopt such a world view.” The ruling represented a victory for several states and numerous environmental and public health groups.
